PERSONAL DATA PROTECTION POLICY

 

Objective and Scope

The Personal Data Protection Act 2010 (“PDPA”) serves to regulate the processing of Personal Data in commercial transactions or employment and LAC Medical Supplies Sdn. Bhd. (Company No. 638327-P) and its related companies (herein collectively referred to as “we”, “us” or “our”) are committed to comply with the PDPA on how we are required to protect your Personal Data.

We recognise the importance of the Personal Data you have entrusted to us and believe it is our responsibility to properly manage, protect and process your Personal Data. We will collect, use and process the data in accordance with the PDPA. By providing the Personal Data to us, you acknowledge and accept that we may retain your information for as long as necessary for us to fulfil the purpose for which your information was collected.

 

Purposes of Collecting Personal Data

The Personal Data are processed for the following purposes but not limited to:

  • communicate with you;
  • facilitate, process, deal with, administer, manage and/or process your application/transaction with us;
  • provide you with information on our products, services, upcoming promotions or events organised by us through social media platforms and/or other appropriate communication channels;
  • conduct market analysis, survey and/or internal activities;
  • conduct credit or financial checks;
  • issue invoices (including e-invoices), printed and on-line publications and complying with other regulatory requirements and guidelines;
  • data transfer to and sharing with our related companies within the LAC and CVS Group (including holding company, subsidiaries, associates, affiliated companies) both local and international whether present or future and to any third-party organisation or persons for the purpose of fulfilling our obligations to you.

Failure to supply us the Personal Data may result in us being unable to provide you with the services and/or products. Your Personal Data may be collected from various on-line forms available during your visits to our websites, business cards and/or any events organized by us.

 

Disclosure of Personal Data

Your Personal Data may be disclosed to the relevant third parties including but not limited to licensees, governmental and/or quasi-governmental departments, agencies, regulatory or statutory bodies, business partners and/or service providers for any of the above purposes.

 

 

CONFIDENTIALITY

 

The Parties herein agree that any information and/or data with respect of this Agreement/Contract/Order Confirmation and its implementation and/or any information and/or data provided by a Party including, but not limited to business, operations, technologies, formula, procedures, processes, methods, trade secrets, improvements, plans, programmes, equipment, (hereinafter referred to as “Confidential Information”) to the other Party in this Agreement either orally or written, directly or indirectly, through any media and format shall be treated as a confidential information.

The Parties agree to take all reasonable measures to keep in confidence, the execution, terms and conditions as well as performance of this Agreement/Contract/Order Confirmation and the Confidential Information of any party shall not be disclosed, make available or assign to any third party without the prior written consent of the party providing the information.

The above restriction is not applicable if the Confidential Information has become generally available to the public at the time of disclosure or it is required by a competent authority party based on the applicable laws and regulations or by the court, arbitration panel and/or other authorized bodies based on the applicable laws and regulations to be disclosed.

The Parties agree that this confidentiality provision shall remain valid and binding even after the Agreement has expired or terminated.

 

ANTI-BRIBERY AND ANTI-CORRUPTION

The Parties undertake to ensure that the Parties and all persons representing or performing services for or on behalf of the respective party to comply with applicable anti-bribery and anti-corruption policies and legislations.

The Parties and any other person(s) responsible for providing or performing this Agreement/Contract/Order Confirmation shall not authorise or offer any payments, gifts or other transfer of value, directly or indirectly, to any government official(s) or private person(s) in order to (i) improperly influence/induce that person to do or refrain from any official act (ii) attempt to gain/maintain the business (iii) secure improper advantage.

Any act or attempt to corruptly offer or give, solicit or receive any gratification to and from any person in connection to the performance of this Agreement/Contract/Order Confirmation is a criminal offence under the Malaysian Anti-Corruption Commission Act 2009 (“the Act”) and if found guilty, either party shall take the necessary action in accordance with the provisions of the Act.
